Competition conditions of Strollme GmbH
1. Organizer
(1) The organizer of the contest is StrollMe GmbH

Hereinafter referred to as "StrollMe."
(2) This contest is in no way connected to Facebook/Instagram and is neither sponsored, supported, nor organized by Facebook/Instagram. The sole contractual partner is StrollMe.
(3) There are no claims against Facebook/Instagram in connection with the contest and its execution.
2. Participation and Duration
(1) All persons who are at least 18 years old at the time of participation, have a Facebook/Instagram account, and reside in Germany or Austria are eligible to participate. Employees of StrollMe and their relatives are excluded from participation. Participation via sweepstakes agencies or automated entry services is also prohibited.
(2) Participation in the contest is free of charge.
(3) The rules for conducting the contest are described on the StrollMe Facebook/Instagram page. Any differing rules stated there take precedence over these terms of participation.
(4) Participation does not depend on the purchase of a product or the use of a service from StrollMe. Purchasing a product or using a service does not increase the chances of winning.
(5) Participation in the contest does not entail any obligation to use specific services or consent to advertising measures.
3. Winner Announcement and Acceptance of the Prize
(1) Winners will be determined 14 days after the end of the participation period and will be contacted via direct message from the StrollMe Facebook/Instagram page.
(2) After being notified, winners have 21 days to send their address, first name, and last name in a private Facebook/Instagram message to StrollMe. If this information is not provided or is provided late, the prize will be forfeited, and a new winner will be selected from the other participants.
(3) If deviations regarding the announcement of winners or the acceptance of the prize apply to a contest, these differing conditions will be specified in close proximity to the contest information on the StrollMe Facebook/Instagram page.
4. Early Termination, Exclusion
(1) StrollMe reserves the right to terminate or interrupt the contest at any time without prior notice and without stating reasons. This particularly applies if circumstances arise that seriously disrupt or prevent the orderly conduct of the contest. Participants have no claims against StrollMe in such cases.
(2) StrollMe is entitled to exclude individual participants from the contest and withhold or reclaim prizes if there are justified reasons, particularly a violation of these terms of participation.
5. Limitation of Liability
(1) StrollMe is liable for damages according to statutory provisions (a) in cases of intent or gross negligence, (b) for culpable injury to life, body, or health, and (c) under the provisions of the Product Liability Act.
(2) In the case of slight negligence in breaching an obligation essential for the proper execution of the contest and on which participants regularly rely (so-called cardinal obligation), StrollMe's liability is limited to foreseeable and typical damages.
(3) Any further liability is excluded.
(4) The above limitation of liability also applies to personal liability of StrollMe’s employees, representatives, and executives.
6. Prizes
(1) The prize consists solely of what is specified on the StrollMe Facebook/Instagram page. Any (additional) costs incurred by the winner through the use of the prize are only covered if explicitly stated in the contest information on the StrollMe Facebook/Instagram page. A cash payment of the prize value or an exchange of the prize is excluded.
(2) The prize is non-transferable to other persons.
7. Prize Shipment
(1) The prize will be shipped at no cost to the winner to the address provided to StrollMe via post or courier.
(2) Before shipping, StrollMe will verify the provided first and last name to ensure the winner is not an employee of StrollMe. If a false name is intentionally provided, StrollMe is entitled to exclude the participant from the contest and withhold or reclaim the prize.
(3) If the provided address is incorrect or if the prize cannot be delivered for other reasons within the winner’s responsibility, there is no entitlement to a re-shipment.
8. Winner Selection
(1) The winner is determined from all timely received entries. If a correct answer is required, the winner will be chosen from all timely submitted correct answers.
(2) Each participant takes part in a specific contest only with their first submission. Multiple comments or multiple entries do not increase the chances of winning.
9. Data Protection / Handling of Personal Data
(1) All personal data (first name, last name, Facebook/Instagram username, and address) will be collected, processed, and used exclusively in connection with the contest in compliance with applicable data protection laws. The personal data provided for the contest will be used solely for determining and notifying the winner, verifying against a list of StrollMe employees, and sending the prize. The data will only be stored until the purpose for which it was collected, processed, and used has been fulfilled. However, if StrollMe is obligated to observe commercial or tax retention periods, storage may last up to 10 years. Personal data will only be shared with third parties (post or courier companies) if they are contracted with the delivery/shipping.
(2) Participants can object to the interim storage of their personal data at any time by sending an email to [email protected]. Participants acknowledge that submitting such an objection automatically results in forfeiting the chance to win.
Facebook/Instagram’s data protection regulations apply, which each participant automatically agrees to by using Facebook/Instagram pages and features.
10. Exclusion of Legal Recourse
(1) German law applies.
(2) Legal recourse is excluded.
(3) StrollMe reserves the right to adapt the participation terms at any time to new circumstances, especially in case of technical or legal changes.
